ArcDraft Terms and Conditions

Welcome to ArcDraft (The brand name for the website architecturaldrafting.com, owned by ArcDraft ArcDraft LLC, hereinafter “ArcDraft”), a digital marketplace that connects drafters and clients to work together on drafting projects. By using the services provided by ArcDraft, you agree to comply with and be bound by the following terms and conditions.

Definitions

  • “User”: Anyone who accesses or uses our platform.
  • “Drafter”: A freelancer who offers drafting services on the platform.
  • “Client”: A user who hires drafters for projects.
  • “Project”: A job or task listed by a client.
  • “Platform”: Refers to ArcDraft.

Acceptance of Terms

By accessing architecturaldrafting.com or using our service, you agree to abide by these terms and conditions and all applicable laws regulated under the jurisdiction of Dubai, United Arab Emirates.

Services

ArcDraft offers a platform where clients can hire drafters for their projects, and drafters can offer their professional services to clients.

User Registration

Users must register an account to access services. You are responsible for providing accurate information and for maintaining the security of your account.

Payment Terms

Payments are processed through Stripe, a third-party payment gateway. Drafters will receive payments upon the successful completion of a project, minus any applicable platform fees. Fee structure: 

  • Depositing funds through debit or credit card remains the accountability of Stripe. There is no fee for depositing funds from ArcDraft
  • Client admin process fee is 2% on top of the total value of the hired project amount
  • ArcDraft commission from drafter is 8% of the total value of the hired project amount
  • Refunds/Withdrawals: If a Client has deposited funds and decides to withdraw before hiring, a withdrawal  fee of 3% will be applied and all banking fees will be paid by the Client

User Responsibilities and Conduct

All users are expected to conduct themselves professionally and ethically. Harassment, fraud, or any form of misconduct will result in account suspension or termination.

Project Submission and Completion

Clients may list projects with specific requirements. Drafters can submit proposals for these projects. Once a project is completed to the satisfaction of the client, it is marked as complete, and payment/payout is released to the drafter. 

Payment/payout schedule to drafters is done on the first week of each month and payout must be submitted before the 25th of the previous month. 

Confidentiality

Both drafters and clients are required to maintain the confidentiality of all information related to the project and may not disclose such information to third parties without explicit consent from the project owner.

By sending a proposal and being hired for it, you agree to abide by mutual non-disclosure agreement:

  1. Purpose

The purpose of this Agreement is to protect the confidentiality and use of certain confidential and proprietary architectural information (“Information”) related to architectural documentation services provided by the Disclosing Party to the Receiving Party.

  1. Definition of Confidential Information

“Confidential Information” refers to any non-public, proprietary, or confidential architectural plans, designs, blueprints, drawings, specifications, models, project details, and any other information related to architectural documentation.

  1. Obligations of Receiving Party
  • The Receiving Party shall use the Confidential Information solely for the purpose of providing professional architectural documentation services.
  • The Receiving Party shall not disclose, copy, reproduce, distribute, or use the Confidential Information for any purpose other than as specified in this Agreement.
  • The Receiving Party shall exercise reasonable care to protect the Confidential Information from unauthorized use or disclosure.
  1. Exceptions

Confidential Information does not include information that:

  • Is or becomes publicly available without breach of this Agreement.
  • Is in the possession of the Receiving Party without restriction in relation to disclosure before the date of receipt from the Disclosing Party.
  • Is independently developed by the Receiving Party without reference to or reliance upon the Confidential Information.
  1. Duration of Confidentiality Obligation

The Receiving Party’s duty to maintain the confidentiality of the Confidential Information shall continue for a period of 2 years from the date of disclosure.

  1. Return or Destruction of Confidential Information

Upon termination of the professional services or upon the Disclosing Party’s written request, the Receiving Party shall promptly return or destroy all copies of the Confidential Information in their possession.

  1. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Dubai, UAE. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts in Dubai, UAE.

Intellectual Property

Unless otherwise specified, the intellectual property rights of the completed project belong to the client.

Dispute Resolution

In the event of a dispute, parties agree to attempt to resolve the issue through direct communication or mediation before taking any legal action. Any legal disputes shall be governed by the laws of Dubai, UAE. ArcDraft shall serve as the designated mediator in any dispute arising before the completion of the client’s proposal. It is expressly understood that once the client’s proposal has been completed, ArcDraft shall not bear any responsibility for damages or loss of funds incurred by either Party.

Should a project be canceled during the project period, a review may be conducted to determine the extent to which services rendered by a drafter were partially completed.

Limitation of Liability

ArcDraft is not liable for any direct, indirect (for example, in the event the Client and Drafter decide to work outside of ArcDraft’s recruitment or marketplace architecturaldrafting.com services), or incidental damages resulting from the use or inability to use the service. Architecturaldrafting.com is a marketplace where a Client must do their own due diligence of the potential hired drafter before making the final decision to hire. 

Termination

We reserve the right to suspend or terminate user accounts that violate these terms and conditions.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Dubai, UAE.

Amendments

ArcDraft reserves the right to amend these terms and conditions at any time. Users will be notified of any changes, which will be effective upon posting.
